  1. An included revision;
  2. An additional chargeable revision;
  3. A new feature or custom-development request; or
  4. A request that cannot reasonably be supported.

7. CUSTOMER CONTENT

The Customer is responsible for supplying the Content required to create the Wedding Website.

This may include:

  • Names.

8. CUSTOMER REPRESENTATIONS REGARDING CONTENT

By providing Content to us, you represent and warrant that:

  • You have the necessary rights, permissions, licenses, or authority to provide the Content.
  • The Content does not knowingly infringe another person's intellectual-property rights.
  • The Content does not unlawfully disclose another person's private or confidential information.
  • The Content does not violate applicable law.
  • You have obtained appropriate permission where necessary to publish photographs, names, personal information, or other materials relating to third parties.
  • You have authority to request publication of the Content on the Wedding Website.

You remain responsible for the Content you provide.

The Company is not responsible for verifying the legal ownership, accuracy, or completeness of Customer-provided Content.

9. CONTENT MODERATION AND REJECTION

The Company may refuse to publish, remove, restrict, or request modification of Content that we reasonably believe:

  • Violates applicable law.
  • Infringes intellectual-property rights.
  • Violates privacy rights.
  • Contains malicious code.
  • Is fraudulent or deceptive.
  • Contains abusive, defamatory, hateful, or unlawful material.
  • Creates a security risk.
  • Violates these Terms.
  • Creates unreasonable legal or operational risk for the Company.

Where reasonably practicable, we will notify the Customer before removing or rejecting such Content.

10. CONTENT DELIVERY AND CUSTOMER DELAYS

The Customer is responsible for providing complete and usable Content in the format reasonably requested by the Company.

Project timelines may be affected if the Customer:

  • Delays providing Content.
  • Provides incomplete Content.
  • Requests repeated changes.
  • Changes previously approved requirements.
  • Fails to provide necessary domain or hosting information.
  • Delays approvals.
  • Becomes unavailable for project communications.

The Company will not be responsible for delays caused primarily by the Customer or by third-party services outside the Company's reasonable control.

11. DESIGN APPROVAL

Before deployment, the Company may provide a preview, demonstration, staging URL, screenshots, or other representation of the Wedding Website.

The Customer is responsible for reviewing:

  • Names.
  • Dates.
  • Event information.
  • Photographs.
  • Venue information.
  • Links.
  • Text.
  • Other supplied Content.

Once the Customer approves the design or requests deployment, the Project may be considered ready for production.

Minor corrections to Customer-provided information after approval may be handled according to the Package's revision policy.

12. REVISIONS

The number of revisions included in a Package will be specified in the relevant Package description, quotation, or order confirmation.

A revision generally means a reasonable modification to existing website content or design within the agreed scope.

The following may be treated as additional work:

  • Major redesigns.
  • Changing the selected template after development has started.
  • Adding new functionality.
  • Adding pages or sections beyond the Package.
  • Custom animations or interactions.
  • Custom integrations.
  • Structural changes to the website.
  • Repeated changes after final approval.
  • Changes resulting from incorrect or incomplete Customer instructions.

Additional work may be subject to additional fees and revised delivery timelines.

13. PRICING

The applicable price will be the price communicated to and accepted by the Customer at the time of purchase or order confirmation.

Prices may vary based on:

  • Package.
  • Design.
  • Customization.
  • Additional features.
  • Domain requirements.
  • Hosting duration.
  • Additional revisions.
  • Custom development.
  • Third-party services.
  • Taxes or government charges, where applicable.

Unless expressly stated otherwise, third-party fees may be charged separately.

14. TAXES

Applicable taxes, including GST or other applicable government charges, may be added to the advertised or quoted price where required by law.

The Customer is responsible for applicable taxes associated with the purchase unless otherwise stated.

15. PAYMENT

Payment must be made through the payment method or payment instructions provided by the Company.

Depending on the Project, the Company may require:

  • Full payment before development;
  • An advance payment before development begins; or
  • Milestone-based payments.

The applicable payment schedule will be communicated to the Customer before or during order confirmation.

The Company may suspend development, deployment, hosting, or other Services where required payments remain outstanding.

16. NON-PAYMENT

If a Customer fails to make a required payment, the Company may:

  • Pause development.
  • Withhold deployment.
  • Suspend access to the Wedding Website.
  • Suspend maintenance.
  • Suspend hosting.
  • Refuse additional revisions.
  • Require payment before resuming Services.

The Company may also charge applicable late fees where such fees were expressly agreed in advance.

17. REFUNDS AND CANCELLATION

Because Wedding Website Services involve design, development, customization, project time, and potentially non-recoverable third-party costs, cancellation and refund eligibility may depend on the stage of the Project.

Unless otherwise stated in a specific Package or written agreement:

Before Work Begins

If the Customer cancels before substantial work has commenced, the Company may provide a refund after deducting any applicable non-refundable payment-processing, third-party, or administrative costs.

After Work Begins

Once design or development work has materially commenced, the Customer may not be entitled to a full refund.

The Company may deduct amounts corresponding to work already completed, resources committed, third-party expenses, and other applicable costs.

After Deployment

Once the Wedding Website has been deployed or the Customer has approved final production deployment, payments may generally be non-refundable except where required by applicable law or expressly agreed otherwise.

Any specific refund policy communicated with the selected Package will take precedence over this general provision to the extent of any inconsistency.

18. THIRD-PARTY SERVICES

Our Services may depend on third-party services, including:

  • Domain registrars.
  • Hosting providers.
  • Cloud infrastructure.
  • Payment gateways.
  • Email services.
  • Analytics providers.
  • Map providers.
  • Video-hosting platforms.
  • Social-media platforms.
  • CDN providers.
  • Security services.

Third-party services may have their own terms, policies, availability limitations, pricing, and technical restrictions.

The Company does not guarantee uninterrupted availability of third-party services.

Where a third-party service becomes unavailable, changes its API, modifies its policies, increases its pricing, or discontinues a feature, we may need to modify, replace, or remove the affected functionality.

19. DOMAIN NAMES

Where domain registration is included in a Package or purchased separately, domain registration remains subject to the terms and policies of the relevant domain registrar and applicable domain registry.

The Customer is responsible for providing accurate registration information.

Domain availability cannot be guaranteed until registration is successfully completed.

If the Customer provides an existing domain, the Customer must have authority to modify its DNS or domain configuration.

The Company is not responsible for loss of a domain resulting from:

  • Incorrect information supplied by the Customer.
  • Failure to renew a domain where renewal responsibility belongs to the Customer.
  • Registrar suspension.
  • Registry policies.
  • Third-party disputes.
  • Actions taken by the domain owner.

20. HOSTING

Where hosting is included, the Wedding Website will be hosted using infrastructure selected by the Company or an applicable third-party hosting provider.

Hosting is subject to:

  • The duration specified in the Package.
  • Applicable resource limitations.
  • Acceptable-use requirements.
  • Third-party infrastructure availability.
  • Payment and renewal status.

Hosting does not necessarily include unlimited storage, bandwidth, traffic, media hosting, email hosting, or other infrastructure resources unless expressly stated.

21. HOSTING EXPIRATION AND RENEWAL

If the hosting period included in the Package expires, the Customer may be required to purchase a renewal or maintenance plan to keep the Wedding Website publicly accessible.

If the Customer does not renew within the applicable period, the Company may:

  • Disable public access.
  • Suspend the Wedding Website.
  • Archive the website.
  • Remove the website from the hosting environment.
  • Delete stored website data after an applicable retention period.

The Company will make reasonable efforts to communicate upcoming expiration where appropriate, but the Customer remains responsible for maintaining an active service period.

22. WEBSITE AVAILABILITY

We aim to keep hosted Wedding Websites available and functional.

However, we do not guarantee uninterrupted availability.

Temporary downtime may occur due to:

  • Emergency maintenance.
  • Hosting-provider outages.
  • DNS issues.
  • Domain issues.
  • Cybersecurity incidents.
  • Software failures.
  • Network failures.
  • Internet infrastructure problems.
  • Third-party service outages.
  • Events outside our reasonable control.

23. BACKUPS

Where technically and commercially reasonable, we may maintain backups of website data.

Backups are intended as a recovery mechanism and should not be considered a permanent archive or guaranteed restoration service.

Customers should retain copies of important original photographs, videos, documents, and other Content supplied to us.

We do not guarantee that every item of Content can always be recovered following a catastrophic technical failure.

24. INTELLECTUAL PROPERTY

24.1 Customer Content

The Customer retains ownership of Content supplied by the Customer, subject to the rights and licenses necessary for the Company to provide the Services.

24.3 License to Customer

Subject to payment of all applicable fees, the Company grants the Customer a limited, non-exclusive right to use the completed Wedding Website for the Customer's intended wedding-related purposes during the applicable service period.

This license does not transfer ownership of the Company's underlying source code, frameworks, templates, development systems, or reusable components unless expressly agreed in writing.

25. THIRD-PARTY ASSETS

Some designs may incorporate fonts, icons, photographs, illustrations, libraries, plugins, APIs, or other assets licensed from third parties.

Such assets remain subject to their respective licenses.

The Company will not knowingly provide third-party assets in a manner that exceeds the applicable license.

26. PORTFOLIO AND MARKETING RIGHTS

Unless the Customer expressly requests otherwise before publication, the Company may display non-sensitive portions of completed Wedding Websites for:

  • Portfolio purposes.
  • Design showcases.
  • Marketing.
  • Case studies.
  • Social-media promotion.

We will take reasonable care when using Customer-related materials for promotional purposes.

Where the Customer requests that their Wedding Website or specific personal content not be used for promotional purposes, the Company will consider and, where reasonably practicable, honor that request.

27. PRIVACY

Our collection and processing of personal data is governed by our Privacy Policy.

The Privacy Policy explains how we collect, use, store, disclose, and protect personal data.

By using our Services, you acknowledge that you have reviewed our Privacy Policy.

28. PUBLIC WEDDING WEBSITES

Unless a Package expressly provides otherwise, a Wedding Website may be publicly accessible through its Production URL.

Customers understand that information intentionally published on a public Wedding Website may be accessible to anyone with the URL and may potentially be indexed, copied, cached, shared, or reproduced by third parties.

Customers should not provide information for public publication that they do not wish to make publicly accessible.

29. RSVP AND GUEST INFORMATION

Where RSVP functionality is provided, guests may submit information through the Wedding Website.

The functionality, information collected, storage period, and availability of RSVP features depend on the applicable Package and technical implementation.

The Customer is responsible for ensuring that the information requested from guests is appropriate and necessary for the intended purpose.

Where reasonably practicable, we will provide notice and an opportunity to resolve the issue before termination.

Immediate suspension may be necessary where continued access creates a security, legal, or operational risk.

32. EFFECT OF TERMINATION

Upon termination:

  • The Customer's right to use affected Services may end.
  • The Wedding Website may be taken offline.
  • Hosting may be discontinued.
  • Additional revisions may cease.
  • Certain stored data may be deleted after applicable retention periods.
